Tidligere har dette udvalg været sammensat af embedsfolk fra regeringen og repræsentanter fra politiet, dommerstanden, anklagemyndigheden, forsvarerne, samt den universitetsbaserede juridisk akademiske fagkundskab. I det konkrete tilfælde valgte regeringen ikke alene at se bort fra den juridiske fagkundskab og forsvarerne, men man valgte også at gøre udvalget anonymt. "
